iMG. Community Terms & Conditions

Introduction

By signing up to the iMGCommunity you agree to be bound by the following terms and conditions.

 

The following user terms apply to all who use the iMG. Community. ‘We’, ‘our’ and ‘us’ refer to The Inspired Marketing Group. ‘You’ and ‘your’ refer to you, the individual user and participant in the iMG. Community.

1. Membership

1.1. On acceptance to the iMG. Community you will be given access to our corporate Slack account and various channels within that account.

1.2. We have the sole right to determine your eligibility for the iMG. Community, and the extent of your access to our Slack account and channel.

1.3. At any time, and without notice, we can remove or restrict your access to this account or these channels if the terms of use are broken.

2. Terms of use

2.1. Users of the iMG. Community must monitor and control all activity conducted through your account and exercise all reasonable efforts to keep all passwords and login information confidential.

2.2. In addition, iMG. Community members must never:

2.2.1. Use the account or channel to canvass, solicit or otherwise seek the direct custom of any person or business within the iMGCommunity for their own benefit. For the avoidance of doubt, this includes but is not limited to, the posting of jobs or opportunities for their own businesses or clients within the account or any channel .iMGCommunity members can utilise the Community to help fulfil work won by their own business, but this must firstly be presented via Direct Message or Email to the iMG. Co-Founders if you are seeking either resource to help fulfil a contract won by your own business or are looking to refer the work onto The Inspired Marketing Group for a “Referral Bonus” as outlined in Clause 5.

2.2.2. Upload to or link from any harmful or malicious technology, including malware, that unlawfully accesses information owned by us or any third party.

2.2.3. Post content that violates applicable laws and governmental regulations, including, but not limited to, all intellectual property, data, privacy and export control laws, and regulations promulgated by any government agencies, including any rules of any national and other securities exchanges.

2.2.4. Allow another person to post from their account or on their behalf.

2.2.5. Post content that is abusive, offensive, vulgar, obscene, hateful, racist, or bigoted, threatening, libellous, defamatory, or fraudulent.

2.2.6. Dox another person, or post content that includes another person’s private or personal information, including but not limited to community forum profile information, images, personal phone numbers, email addresses, addresses and National Insurance numbers.

2.2.7. Post content to which the user does not have the required rights under law and under contractual and fiduciary relationships (such as proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements).

2.2.8. Post spam or advertisements.

2.2.9. Impersonate any person or entity, or falsely state or otherwise misrepresent an affiliation with a person, organisation, or entity of The Inspired Marketing Group.

2.2.10. Interfere with or disrupt the operation or integrity of the iMG. Community or any information, data, content, or other materials available on or through the iMG. Community.

2.2.11. Access the iMG.Community to build a similar or competitive product or service or copy any ideas, features, functions, or graphics of the iMGCommunity or The Inspired Marketing Group’s business model, clients, or prospects.

2.2.12. Authorise, permit, enable, induce, or encourage any third party to do any of the above.

2.2.13. Do anything to violate the spirit of these terms.

2.2.14. Promptly notify us if you become aware of or reasonably suspect any illegal or unauthorised activity or a security breach involving your account, including any loss, theft or unauthorised disclosure or use of a username, password, or account.

3. Moderation

3.1. The iMGCommunity is intended to be a place for users to connect, communicate and share information, experiences, tips, and thoughts on marketing. To ensure and foster a positive environment, we may act as moderators/administrators for iMGCommunity. 

3.2. We reserve the discretion to remove and alter any user content at any time, with or without notice, for violation of these terms, or anything we otherwise deem inappropriate and/or unlawful, or for any other reason. 

3.3. We have discretion to block users who violate these terms from posting and/or to terminate the user’s iMGCommunity account.

3.4. You agree that should any monthly membership fees lapse, or at the end of any project delivered under our Marketing Services Agreement, or at our sole discretion access to the email account can be temporarily removed, revoked and/or deleted.

4. The Inspired Marketing Group Membership

4.1. The membership has three tiers; iMG. Influencer, iMG. Maestro, iMG. Genius. All members start at our Influencer level and progress through to the top level of Genius over time.

4.2. Progression is achieved via, but not limited to, membership tenure, quality of work produced on behalf of us, customer feedback or the quality and appropriateness of your interaction within the iMG. Community.

4.3. It is at the sole discretion of The Inspired Marketing Group what level a member is given and how, and how quickly they progress through the levels.

4.4. The Inspired Marketing Group also reserves the right, without notice, to demote the level of membership or expel a member based on, but not limited to, the quality of work produced on behalf of us and customer feedback.

4.5. You are authorised to advertise your association with The Inspired Marketing Group, specifically on LinkedIn, and are granted to use logos whilst you have a valid membership. You are only permitted to advertise your employment type as “Contract” or “Freelance” and ­are precluded from mentioning any association with any customer of ours. This includes, specifically but not limited, to the use of customers logos and/or names.

5. Referral of Work

5.1. If you refer work to us and this moves to a live project, we agree to pay you 5% of the contract value as a one-time referral bonus.

5.2. Payment will be made within 30 days of the payment being received by us from the customer for this specific project.

6. Guarantee of work

6.1. By joining the iMG. Community you access our community and referral scheme, but this does not guarantee you will receive paid projects on behalf of The Inspired Marketing Group.

6.2. When we win a new customer, we select a virtual team from our community based on the customers’ requirements and your skill set

6.3. As we cannot guarantee customer wins or your availability to work on projects we aren’t able to guarantee work from your membership.

7. Permission to use your image on our website

7.1. By joining the iMG. Community you grant us permission and consent to use your LinkedIn profile picture along with a brief biography of your experience, skillset and sector experience which will be placed on our website (TheIMGroup.co.uk) for presentation under any legal condition, including but not limited to: publicity, copyright purposes, illustration, advertising web content and internal use.

7.2. You acknowledge and agree that there shall be:

7.2.1  No payment for this release.

7.2.2 No royalty, fee, or other compensation will become payable to you by reason of such use.

7.3. You can revoke this authorisation at any time by notifying us by email at hello@TheIMGroup.co.uk.

7.4. The revocation will not affect any actions taken before the receipt of this written notification. Images will be stored in a secure location and only authorised staff will have access to them. They will be kept as long as they are relevant and after that time destroyed or archived.

8. Your rights to cancel

8.1. You can cancel your membership at any time by emailing hello@TheIMGroup.co.uk.

8.2. We will then ensure that we remove your access from the channel and any associate to you on our website as soon as is practicable.

9. Changes to these terms

9.1. We may revise, update, or otherwise change these Terms at any time by posting updated terms on the Platform. You are expected to check this page (www.TheIMGroup.co.uk/community-terms) from time to time so that you are aware of any changes, as they are binding on you. 

9.2. All changes are effective immediately when posted and apply to all access and use of the platform thereafter. We may send registered users an email notice of the revised terms, but such notice is for your convenience only and shall not be required for the effectiveness of the changes. 

9.3. If any change is unacceptable to you, your only remedy is to stop using the platform. If you do not cease using the platform, you will be conclusively deemed to have accepted the changes. 

9.4. Any revised versions of these Terms shall supersede all previous versions.
